Terms of Service

Stamp is a service operated by TripJar Travel LLC (“TripJar,” “we,” “us,” or “our”), a New Jersey limited liability company located at 151 Black River Rd, Long Valley, NJ 07853. “Stamp” is a brand of TripJar Travel LLC. By using the Stamp website or app (the “Service”), you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older and able to enter into a binding contract.

2. What the Service does

Stamp lets you select an artist-designed postcard tied to a physical location, write a message, and have a real postcard printed and mailed to a recipient you specify. Postcards are printed and mailed through our fulfillment provider.

The Service currently mails only to and from addresses within the United States. Orders with non-US sender or recipient addresses are not accepted.

3. Orders, pricing, and payment

  • The price per postcard is $8.00 USD, shown at checkout before you pay. Applicable sales tax, if any, is calculated and added at checkout.
  • Payments are processed by Stripe. We do not receive or store your full card number. Your use of Stripe is subject to Stripe’s terms.
  • Placing an order authorizes us to charge your payment method for the order total. An order is confirmed once payment succeeds.

4. Content you submit

“User Content” means the message text, recipient and sender details, and any other material you provide for a postcard.

  • You keep ownership of your User Content.
  • You grant TripJar a limited, worldwide, royalty-free license to use, reproduce, and print your User Content solely to fulfill your order and as needed to operate and support the Service.
  • You are solely responsible for your User Content and for having the right to send it, including the right to mail to the recipient’s address you provide.
  • Your User Content must comply with our Acceptable Use Policy. We may screen, refuse, or cancel any order that we believe violates it, and we may decline to print or mail any content at our discretion.

5. Address accuracy and delivery

  • You are responsible for the accuracy of the sender and recipient addresses you enter. We are not responsible for postcards that are undelivered, delayed, or misdelivered because of an incorrect or incomplete address you provided.
  • We verify recipient addresses where possible, but we do not guarantee delivery or any specific delivery time. Postal delivery timing is outside our control.

6. Refunds and cancellations

  • If a postcard fails to be mailed due to a problem on our side, we will refund that order.
  • If a postcard arrives misprinted or damaged due to a production error on our side, contact us within 30 days and we will reprint it or refund that order.
  • Once a postcard has been printed or handed to the mail stream, the order cannot be canceled or refunded, because production has already occurred.
  • We do not refund orders that are undeliverable or delayed due to an address error you entered, or for the content of a message you chose to send.

7. Intellectual property

The Service, including the artist-designed card artwork, templates, logos, and software, is owned by TripJar or its licensors (including participating artists) and is protected by intellectual property laws. You may not copy, resell, redistribute, or create derivative works from the card artwork or any part of the Service, except for the personal postcard you order through the Service.

8. Copyright complaints (DMCA)

We respect intellectual property rights and respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (“DMCA”). If you believe content submitted through the Service infringes a copyright you own or control, send a written notice to our designated agent at support@stamppostcard.com that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and enough detail to locate it; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner’s behalf. We remove infringing material and may terminate the access of repeat infringers. Knowingly misrepresenting that material is infringing may subject you to liability under Section 512(f) of the DMCA.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any postcard will be delivered by a particular date. Some jurisdictions do not allow the exclusion of certain implied warranties, so some of the above exclusions may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, TripJar and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of the Service. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited or excluded under applicable law (such as liability for death or personal injury caused by negligence, or for fraud or willful misconduct).

11. Indemnification

You agree to indemnify and hold harmless TripJar and its owners, employees, and suppliers from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms or the Acceptable Use Policy — including any claim by a recipient of a postcard you sent.

12. Dispute resolution; arbitration; class-action waiver

Please read this section carefully — it affects how disputes are resolved.

  • These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules.
  • Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small-claims court.
  • You and TripJar each give up the right to sue in court and the right to a jury trial, and instead agree to resolve disputes through individual arbitration (except for the small-claims option above).
  • You and TripJar waive the right to participate in a class action or class-wide arbitration.
  • 30-day opt-out. You may reject this arbitration agreement by emailing support@stamppostcard.com within 30 days of first accepting these Terms. If you opt out, neither you nor TripJar can require the other to arbitrate.
  • If the class-action waiver is found unenforceable, the remainder of this section still applies.

13. Time limit to bring claims

Any claim arising out of or relating to these Terms or the Service must be filed within one (1) year after the claim arose; otherwise it is permanently barred, except where applicable law does not allow such a limitation.

14. Electronic communications

By using the Service, you consent to receive communications from us electronically (such as emails and notices posted on the Service), and you agree that electronic communications, agreements, and notices satisfy any legal requirement that such communications be in writing. We are not obligated to send messages other than as needed to operate the Service (for example, your receipt).

15. General

  • Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including postal or carrier delays, acts of God, natural disasters, war, terrorism, labor disputes, or failures of telecommunications or third-party services.
  • Assignment. We may assign these Terms or our rights and obligations, in whole or in part, without restriction (for example, in connection with a merger or sale). You may not assign your rights without our prior written consent.
  • Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
  • Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and TripJar regarding the Service and supersede any prior agreements.

16. Changes to these Terms

We may update these Terms from time to time. We will give reasonable notice of material changes (for example, by posting the updated Terms here with a new “Last updated” date). Changes apply going forward only and do not affect any dispute that has already arisen. If you do not agree to a change, stop using the Service.
